Staff Analysis of the Legislation

SUMMARY:  LC 33 6032S  Authorizes schools to stock and administer to students certain medications for treatment of respiratory distress.

REQUIREMENTS:

  • schools may acquire and stock a supply of levalbuterol sulfate used to treat perceived respiratory distress including, but not limited to, wheezing, shortness of breath, and difficulty breathing 
  • local boards must adopt a policy authorizing school personnel to administer the medication and provide information to personnel on how to recognize symptoms and to administer the medication
    • the authorization to administer the medication applies whether or not the student has a prescription for the medication
  • the school may designate an employee trained or who has received information in its use to be responsible for storage and distribution of the mediation
  • medication may be administered by the trained employee to a student believed by the employee in good faith to be experiencing a perceived respiratory distress
    • such employee shall be immune for civil liability related to the administration of the medication
  •  

EFFECTIVE DATE:  Upon approval by the General Assembly and Governor.
